The Chișinău Court of Appeals definitively sentenced Ilan Şor to 15 years in prison

The Chișinău Court of Appeals:

1. rejected as untimely the joint appeal of lawyers Calaida and Colenco;
2. rejected as unfounded the appeal of lawyers Balan and Ulanov;
3. admitted the appeal of the prosecution and the representative of Banca de Economii (BEM);
4. partially overturned the sentence of the first-level court, and ultimately concluded:

• Ilan Şor was found guilty of committing the crime provided for by art. 190 para. (5) of the Criminal Code (fraud), with the establishment of a sentence of 12 years in prison, with execution in a closed penitentiary, with the deprivation of the right to hold positions in the banking system for a period of 5 years;
• Ilan Şor was found guilty of committing the crime provided for by art. 243 para. (3) from the Criminal Code (money laundering), with the establishment of a 6-year prison sentence, with execution in a closed penitentiary;
• According to art. 84 of the Criminal Code, determining a final combined sentence of 15 years of imprisonment, in a closed penitentiary, with the deprivation of the right to hold positions in the banking system for a period of 5 years.

The prison term will be calculated from the moment of arrest, including the period of pre-trial detention.

BEM’s civil action was fully admitted, with a judgment in the amount of 5,291,708,829 Moldovan lei ($ 295,462,562 USD / € 267,204,837 Euro) to be collected from the defendant.

Otherwise, the sentence of the first instance court was upheld by the Court of Appeals.

The Court of Appeals decision is definite and can be executed immediately, while the defendant has the right to appeal to the Supreme Court of Justice.
